Justice Souter denies injunction for stay of presidential election
Justice Souter's Clerk has informed Mr. Berg that Mr. Berg's application for an injunction to stay the November 4th election has been denied. (The U. S. Supreme Court Docket is below.)

The Al-Akhbar daily, known to have close contacts to Palestinian leaders in Lebanon, quoted sources in Ramallah claiming that in a meeting in July with Palestinian Authority President Mahmoud Abbas and Prime Minister Salam Fayyad, the two heard from Obama "the best things they ever heard from an American presidential candidate."
The report claimed Obama told Abbas and Fayyad he "supports the rights of the Palestinians to east Jerusalem, as well as their right to a stable, sovereign state," but he petitioned them to keep the remarks confidential.
Asked for comment by WND, chief Palestinian negotiator Saeb Erekat would neither confirm nor deny knowledge of Obama's purported remarks.

This is a subject close to my heart. Do you know that we have adult students at the school where I teach who are not US citizens and who get the PELL grant, which is a federal grant (no pay back required) plus other federal grants to go to school?
One student from the Dominican Republic told me that she didn't want me to find a job for her after she finished my program, because she was getting housing from our housing department and she was getting a PELL grant which paid for her total tuition and books, plus money leftover.
She was looking into WAIT which gives students a CREDIT CARD for gas to come to school, and into CARIBE which is a special program (check it out - I did) for immigrants and it pays for child care and all sorts of needs while they go to school or training. The one student I just mentioned told me she was not going to be a US Citizen because she plans to return to the Dominican Republic someday and that she 'loves HER country.'
I asked her if she felt guilty taking what the US is giving her and then not even bothering to become a citizen and she told me that it doesn't bother her, because that is what the money is there for!
I asked the CARIBE administration about their program and if you ARE a US Citizen, you don't qualify for their program. And all the while, I am working a full day, my son-in-law works more than 60 hours a week, and everyone in my family works and pays for our education.
Something is wrong here. I am sorry but after hearing they want to sing the National Anthem in Spanish - enough is enough. Nowhere did they sing it in Italian, Polish, Irish (Celtic), German or any other language because of immigration. It was written by Francis Scott Key and should be sung word for word the way it was written. The news broadcasts even gave the translation -- not even close. Sorry if this offends anyone but this is MY COUNTRY.
IF IT IS YOUR COUNTRY SPEAK UP -- please pass this along. I am not against immigration -- just come through like everyone else.

NEW YORK – Birthplace, religion, black liberation theology, passport, Pakistan, school expenses and records, house deal, friends, mentors and clients.
These are among the questions that despite months of campaigning for the presidency of the United States, thousands of hours in front of reporters and cameras, and hundreds of members of a massive campaign staff, the public still doesn't have fully answered about Illinois Sen. Barack Obama.
Just four years ago, Obama essentially was an unknown state legislator who with the help of the Chicago political system took over a seat in the U.S. Senate. He stated then he was unqualified for national office, but within about two years launched his bid for the White House, knocking off one of the powerhouses of Democratic politics, Sen. Hillary Clinton, in the primaries.
The questions, then, abound as he's proposed giving the United Nations hundreds of billions of dollars, promised 95 percent of Americans a tax cut and pledged to pursue environmental campaigns even if coal companies go bankrupt because of that.

Northcom has announced that two more U.S. military units will be assigned for domestic homeland security missions, bringing the total number of combat ready service members operating inside the U.S. to around 4,700, as fears grow about the increasing militarization of law enforcement.
The announcement follows the controversy surrounding a September 8 Army Times report (revised on September 30), which revealed that the 3rd Infantry Division’s 1st Brigade Combat Team, fresh from combat duties in Iraq, would be operating inside America for tasks including “civil unrest and crowd control,” a detail that was later denied by Northcom despite the concession that forces would be armed with both non-lethal and lethal weapons as well as having access to tanks.
“In the next three years the military plans to activate and train an estimated 4,700 service members for specialized domestic operations, according to Air Force Gen. Gene Renuart, commander of U.S. Northern Command, which was created in 2002 for homeland defense missions,” reports the Colorado Independent.
“It’s to help us manage the consequences of a large-scale event,” said Renuart. “We have one [unit] now trained and equipped and assigned to the Northern Command. We’ll grow a second one this calendar year of 2009 and a third one in the calendar year 2010 so we can provide the nation three sets of capabilities that could respond to an event of the size of 9/11 or larger.”
But as Mike German, national security counsel for the American Civil Liberties Union’s legislative office in Washington., D.C., points out, “This isn’t a military police brigade or a civil affairs brigade. This is actually a combat brigade being assigned a domestic mission.”

Trying to lift campaign above race under slogan: Let issues be the issue
The United States’ longest presidential campaign ever was dominated by the promise of a new era by both candidates, Senators Barack Obama of Illinois and John McCain of Arizona. To win the White House, Republican McCain must beat all the polls which uniformly favored his Democratic rival. A record turn-out of more than 130 million is expected, of which one quarter opted for an early vote.
Twenty-four hours before voting, the Grey PR agency of New York City tried to lift the duel above race with a flyer which asked Americans to “Let the issues be the issue.” The flyer was snatched up within hours to become a collectors’ item.
The death of Obama’s grandmother from cancer injected drama into the closing hours of the marathon. In another last-minute development, Alaska governor Sarah Palin, McCain’s running mate, was cleared in an ethics probe known as Troopergate.
The next US president will have to grapple urgently with seismic dilemmas left over from the Bush administration, notably the global economic crisis, the Iraq and Afghanistan wars and, at some point, the long-lingering Middle East conflict.
If elected, Obama would make history as the first dark-skinned president in the White House, but his foreign policies as distinct from his electioneering rhetoric are still an enigma. Although many of his predecessors shed their campaign backers and picked a new team upon entering the Oval Office, still it is remembered that a hard left Chicago group sponsored and largely funded his run.
Many Israeli-American voters voted for McCain as a safer choice for Israel, fearing that pro-Arab figures would step out from behind Obama’s Middle East campaign advisers and be installed in key positions in his administration. Aware of this, Dennis Ross, Middle East envoy under Democratic and Republican presidents, and Martin Indyk, former ambassador to Israel, issued pre-election statements assuring Israel they had nothing to fear from Obama.
However, Rob Malli, who is in close rapport with Syrian president Bashar Assad and the radical Hamas headquarters in Damascus, is still around. Although Obama claimed earlier to have dropped this controversial figure from his team of advisers, DEBKAfile’s Middle East sources confirm that he continued to use Malli discreetly to liaise with Arab leaders as his representative.
A lesser known fact is that Malli is a personal friend of Dr. Samir Thaki, Syria’s top negotiator in the indirect talks with Israel brokered by Turkey. He played a shadowy but firm role in those talks under Obama’s policy guideline to back Damascus’ push for a complete Israel withdrawal from the Golan. This ultimatum kept the Bush administration from backing those negotiations and explains why Assad preferred to stall until a new US president was elected.
If Israel’s transitional prime minister Ehud Olmert goes along with this line – he is still weighing the option - it would represent Israel’s biggest concession ever to an Arab state and hamper the chances of his successor, foreign minister Tzipi Livni, to lead their Kadima party to victory in Israel’s February 10, 2009 general election.
Israel’s opposition has said it would not be bound by any such concessions. However its endorsement by Obama, if he is elected US president, would represent his first step for ushering in his new Middle East policy based on drawing Damascus out of its alliance with Iran. Israel would then find itself on a collision course with Washington in the early days of a potential Obama presidency.
All 435 House seats and a third of the Senate are also up for vote on Nov. 4.

Lebanese sources and eye witnesses report Syrian tanks, artillery and commando units have taken up battle positions in four villages around Hasbaya opposite Mt. Hermon and northern Israel.
According to DEBKAfile’s military sources, Syrian tanks and artillery units continued to move into their new positions Sunday and Monday, Nov. 2-3, so completing their deployment the full length of the Syrian-Lebanese border. Elements of the Syrian 10th, 12th and 14th Divisions and the 3rd Army - withdrawn last week from the 600-km long Syrian-Iraq border - are now poised opposite Israeli positions holding the disputed Shebaa Farms enclave on Mt. Hermon.
Military sources say that whereas opposite the northeastern Tripoli region, Syrian forces are strung out in small clusters of 2 to 3 tanks one or more kilometers apart, their tank units are massed tightly opposite Mt. Hermon and northern Israel.
There are other differences: Heavy Syrian armor is positioned well back from the front-line infantry and commando troops in the north, whereas tanks, artillery and special forces are deployed right up to the border opposite South Lebanon and Israel.
Western and Lebanese military observers relate Syria’s military movements to Damascus’ threats, growing more strident Sunday, of “painful punishment” for the US Oct. 26 raid in northern Syria unless Washington apologizes, clarifies its action and pays compensation.
These observers stress that Damascus has no real expectation of a US apology or clarification, because Syria knows as well as the US that the target was its own forward military base for terrorist strikes in Iraq.
While insisting that an innocent farm was attacked and the 8 people killed were all civilians, the Syrians are taking advantage of the Bush administration’s silence to argue that Damascus has the same right as Washington to carry out cross-border attacks against “terrorist targets” i.e. in Lebanon and Israel. Damascus is winding the tensions up to a pitch where some military action against a US Middle East target or ally in Lebanon or Israel is becoming hard to avoid.
Senior IDF officers and some Western military sources are perplexed by the Israeli government’s failure to pursue deterrent action against the Syrian tanks poised in battle array on its border. Instead, the outgoing prime minister Ehud Olmert is busy trying to reviving indirect talks with Syria before he quits, while defense minister Ehud Barak and Kadima leader Tzipi Livni appear unconcerned.

"If somebody wants to build a coal-powered plant, they can," Obama said in an interview with the San Francisco Chronicle. "It's just that it will bankrupt them because they're going to be charged a huge sum for all that greenhouse gas that's being emitted."
Publicity over the plan to use "carbon credits" to force the coal industry to either clean up its emissions or get out of business comes on the heels of news that Obama plans to use "price signals" to control America's energy use, and Republicans have pounced on Obama's words with an aggressive campaign in the coal-rich battleground states of Ohio and Pennsylvania.
ABC News reports a robocall being made to voters that focuses on Obama's "bankrupt" comment.
"I'm calling on behalf of John McCain and the RNC to tell you that coal jobs, which are so important to our community are in jeopardy," says the call. "Listen to Barack Obama's plans to bankrupt the coal industry." The call then plays audio of Obama's words, quoted above.

JOHNSTON, Iowa – In a recently publicized video from the Democratic primaries, Sen. Barack Obama said the government should drive energy bills up though "price signals" in order to force Americans into more environmentally friendly choices.
In the Nov. 9, 2007, interview on Iowa Public Television's "Iowa Press," Obama said Americans like driving SUVs and leaving the lights on, but since "it is undisputable that the climate is getting warmer," consumers would have to change their habits.
When asked what would make consumers change, Obama said government-created "price signals" would make people more mindful of energy costs and compel them to start changing light bulbs and turning off light switches.
Associated Press reporter Mike Glover asked, "How do you convince people to change their lifestyle, to live differently?"
Obama's answer, viewable in the video below, was, "I think it is important for us to send some price signals to change behavior. You know, if electricity goes up, people start becoming more mindful of their electricity bill."

(HONOLULU)(November 1, 2008) Internet powerhouse Andy Martin has ignited a firestorm in Hawai'i over Barack Obama's bogus "original" birth certificate. Martin won a stunning victory Friday afternoon (October 31st) when the State of Hawai'i backed his assertion that there was an original, "typewritten, 1961" birth certificate, called a "Certificate of Live Birth" or "COLB" in Hawai'i, that no one has previously seen. Hawai'i officials retrieved and examined the document after Martin filed a lawsuit seeking access to the historic 1961 original.
Obama has falsely claimed to have placed the "original" on the Internet. Factcheck.org has falsely claimed to have seen this document and posted it on the Internet; that is not true. CNN has falsely ridiculed Martin.
Hawai'i officials have now refuted Obama's false assertion.
Martin's victory in Honolulu will roil the final weekend of the presidential campaign. Internet chatter is expected to explode as the issue moves to the front page over Saturday and Sunday. Swing voters may be swayed by the exposure that Obama has brazenly been lying to the American people. "We just lobbed a grenade into the final weekend of the presidential campaign," says Andy.
"I am ecstatic. I called Obama a liar. I called Factcheck.org 'ObamaLies.org.' I said CNN was sloppy and lazy and wrong. And I was right. The State of Hawai'i has now backed me up. Whew. I knew I was right, but I feel a lot more comfortable knowing that I have started to get the machinery moving in state government. The original document is now obviously protected and safe from any tampering by Obama.
"My lawsuit started a firestorm in Hawai'i. The circuit judge has set a hearing for November 18th (a report in the Honolulu Advertiser for November 1st for an earlier hearing date of November 7th is inaccurate; that date was cancelled).
"CNN also has egg on its face, because, once again, Hawai'i backs my contention that the original document has never surfaced in public. CNN tried to demean me by contradicting my accurate claim.
"Now Obama, Factcheck.org and CNN have been exposed as liars. I said there was a 'secret,' original, typewritten birth certificate that had never been disclosed, and that document was the original COLB, not the phony 'original' that CNN placed before its viewers.
"Why would Hawai'i officials review the vault document at the Eleventh Hour if my lawsuit wasn't causing a furor in Hawai'i state government? Why? The Friday before the election?
"Mine is the only logical, rational, properly prepared lawsuit that has been filed to open Obama's secret records. I sued in the proper state in the proper court against the proper officials for the proper remedy. And they are responding properly. The judge has properly, although not as quickly as I would have preferred, set a hearing to consider my claims. I have not filed outrageous or exaggerated pleadings.
"I merely sought access to a document based on its scholarly and news value and because I had been tipped by my sources inside state government that Obama was lying. My network of informants within state government helps me and guides me. Others filed lawsuits outside Hawai'i that have either been dismissed or discredited. In a Honolulu news conference on October 22nd Martin disclosed that Frank Marshall Davis was the biological father of Barack Obama, not Barack Obama senior. The Obama campaign has not denied Martin's claim.

Considerable evidence still points to candidate's birth in Kenya

HONOLULU – Even though Hawaii officials now claim to have verified the authenticity of Sen. Barack Obama's birth certificate – in hopes of ending widespread speculation and even multiple lawsuits challenging the Democrat candidate's constitutional qualification to be president – it turns out there is still reason for serious questioning.
In fact, there is considerable evidence that Obama was born in Kenya, not in Hawaii as the candidate and his campaign have maintained.
As WND reported from Honolulu last week, Gov. Linda Lingle instructed the Hawaii Department of Health to make sure no one in the press obtains access to Obama's original birth certificate. Lingle's letter to WND made clear that the original doctor-generated and hospital-released birth certificate on file with the state's health department would be released to the press if Obama so requested – but to date the candidate has made no such request.
The governor's communication with WND also left ambiguous whether the Obama birth certificate on file with the Department of Health was originally generated by a Hawaii doctor after giving birth to Obama in Hawaii, or generated in Kenya and subsequently registered by the Obama family in Hawaii.

**UPDATE: Hearing that this might show today. Via the API site, the Obama Campaign is trying to buy off the release:
” Obama’s campaign manager contacted API by telephone and email offering 3 million US dollars followed with a request to API to cancel the deal with Fox News Network.
Ten days ago API received the first request to accept 2 million US dollars by Mr Ed Hale, President of Plains Radio, Texas - USA, in an effort to suppress the information from reaching the public before the coming US Presidential elections.
API has now taken a decision to contact the American Embassy in Oslo, Norway as soon as possible in order to report the matter and hand over the evidence for investigative purposes.
API’s Canadian lawyer is expected to fly to Oslo shortly in order to assist in the legal matters that arise from the bribery attempt.
